If you own a home in a planned development, chances are you’ve encountered a Homeowners Association. Most people think of HOAs as the group that keeps the grass green and the clubhouse clean. That’s true, but it’s far from the whole story.

HOAs aren’t just maintenance crews with a monthly fee. They are governing bodies with legal authority over your property. Understanding that structure—before you sign or when issues arise—can be the difference between peace of mind and unexpected stress.

What Is an HOA, Really?
A homeowners association (HOA) is a private organization that manages shared spaces and enforces community standards in a residential neighborhood. It can cover everything from landscaping to noise rules to roof colors.

When you buy a home in an HOA community, you agree—legally—to follow its rules and contribute financially to the upkeep of the neighborhood.

The governing documents (often called CC&Rs) act as the HOA’s constitution. They may include architectural guidelines, usage restrictions, pet policies, and more. Every HOA is different, and so are the rules you’re agreeing to.

So... What Can They Actually Do?
Here’s what most people don’t realize:

  • They can fine you if you break the rules. And those fines can stack up fast.

  • They can restrict your use of your own property—from paint color to how long guests can stay.

  • They can place a lien on your home if you don’t pay your dues.

  • And yes, in many cases, they can foreclose.

That’s not alarmism. That’s California civil code.

Why This Matters for Buyers and Owners
HOAs can offer beautiful amenities and help protect property values, but they also come with power and responsibility. If you’re buying into an HOA, reviewing the documents is just as important as inspecting the roof.
